Below you will find a link to a video recording of the panel discussion held on October 27th, 2015.  The panel event was organized by three groups: The New York City Paralegal Association; The New York City Metro Area Chapter of ACEDS (Association of Certified eDiscovery Specialists); and The New York Chapter of Women in eDiscovery.  The topic of the discussion was “eDiscovery Nightmares, Just in Time for Halloween”, and the conversation covered such topics as: Cloud Computing; Social Media; Mobile Devices; and Jurisdictional Issues.  I feel that you might find this information to be interesting and useful.

The panel was co-moderated by me (Joe Bartolo, J.D., Regional Manager of Kiersted Systems), along with Brad Schaffel, CEDS, Litigation Support Manager of Wilmer Hale in New York.  The subject matter expert panelists included:  Dera Nevin, Esq., of Proskauer; Alan Winchester, Esq., of Harris Beach; Scott Gibbs, EnCE of Direct Data Discovery; and Anthony Vescova, of Nixon Peabody.  The event Hosted by Nixon Peabody in their offices in New York City, and sponsored by them, as well as additional sponsors DTI and Ricoh.   The videography was provided by the New York based company Litigation Video Technology.

Information Governance: Defensible Disposition…How can e-discovery technology can be used to help corporations identify data that is outside the retention policy, and not subject to a litigation hold.
Issues that we intend to discuss will be as follows: Information Governance strategies; Risk assessment; Reducing risk of potential liability through defensible disposition; Releasing litigation holds when litigation ends; Reducing costs for e-discovery processing in future litigation; reducing storage costs of archived data; Corporations and their relationship with outside counsel; law firms and defensible disposition of their data, and their client’s data; data privacy protection; and documentation of the process.

Steven Berrent, C.E.O, eMag Solutions
In 2011, Mr. Berrent was selected by the ABA as Journal as a “Legal Rebel”, one of  the legal industry’s top 10 innovators among professionals at the nation’s top 250 firms.  Prior to his current role, Steven served as Managing Director of WilmerHale Discovery Solutions (WHDS), Wilmer Hale’s lauded internal eDiscovery solution.  Mr. Berrent also previously served as Director of Litigation Services as Davis Polk, and was an associate at Weil Gotshal & Manges in New York and was a member of their eDiscovery task force. Steven was also Director of Information Technology for former Vice President Al Gore’s Presidential campaign.
Mr. Berrent is a frequent speaker, presenter and writer on various topics related to legal practice, eDiscovery and technology.  Mr. Berrent received his J.D. from Cornell Law School in 2004 and a BA in Political Science from Emory University in 1997.
John Kapp, Manager, Shearman & Sterling
Based in New York, he oversees e-discovery services for the firm’s global litigation, antitrust, international arbitration and FCPA practices. Mr. Kapp, who has worked in litigation support since 1997, has been with Shearman & Sterling for the past ten years. Mr. Kapp has participated as a subject matter expert panelist at events throughout the United States and the E.U. Prior to joining the firm, he headed the litigation support departments at Willkie, Farr & Gallagher and Darby & Darby.
Dana Post, Esq., Special Counsel, E-Discovery and Data Management, Freshfields Bruckhaus Deringer US LLP
As a member of the firm’s cybersecurity practice, she counsels clients on cybersecurity preparedness and data breach litigation strategy. She is also responsible for counseling global companies on privacy issues arising in cross-border litigations including under the data protection laws in Europe, Asia and Latin America, blocking statutes, and bank secrecy laws. Finally, Dana advises clients on their e-discovery obligations including the preservation, collection, processing, review, and production of electronic information. In addition to being a member of The Sedona Conference WG 6, she is a member of the International Association of Privacy Professionals and Women in e-discovery organization. She is a frequent lecturer on e-discovery and the data protection laws including at Pace
Law School.
Brian Seward, Managing Director & Consultant, Knowledge Strategy Solutions. LLC
Brian has been a practicing attorney in Washington, D.C. and New York for 20 years, and has spent the past 10 years specializing in Information Governance. Prior to joining KSS, Brian led the Regulatory Retention and Supervision Product Management team at Bank of America responsible for development, management and support of Bank of America electronic archiving and discovery platforms for its broker dealers. Supporting the bank’s legal, compliance and compliance supervision functions, Brian possesses a deep understanding of the complex and constantly-changing regulatory obligations facing today’s companies and the information governance challenges those obligations present. Brian brings with him to KSS broad experience in e-discovery response and production for matters large and small, and couples that with unique experience with regulatory compliance technology and management for the financial services industry. Brian has a B.A. in Public Policy Studies from Duke University and J.D. from the University Of Virginia School Of Law.

This year at its conference, ACEDS will commence an annual celebration recognizing outstanding individual achievements and efforts in the e-discovery community. Awards will be given in seven categories to ACEDS members and others that have been nominated by their peers as pioneers and innovators in the e-discovery industry, or have otherwise shown special dedication to advancing the profession.

The deadline to submit award nominations is July 15, 2015.

The Awards will be Issued  on the 3rd Day of the Annual ACEDS Conference.  Winners will receive various gifts and recognition, including a 1 year free ACEDS membership.

Voting Categories Include the Following:

1.  Lifetime Achievement Award
This award is given to an individual in the e-discovery field who has shown a lifetime commitment to the advancement of the e-discovery profession. This person has been a pioneer in promoting excellence in e-discovery, has served as a leader and a mentor to other e-discovery professionals, and has dedicated his or her career to raising awareness of e-discovery issues on a global scale. Candidates do not have to be ACEDS members.

2.  E-Discovery Person of the Year
This award is given to a member of ACEDS whose on-the-job achievements have had a significant impact on and contributed to the advancement of the e-discovery profession. This individual has gone above and beyond in the last year to support e-discovery initiatives within his or her department, organization, community or group and has exhibited extraordinary dedication to performing e-discovery in a manner that is “just, speedy and inexpensive.” Only ACEDS members will be considered for this award.

3.  CEDS Ambassador Award
This award recognizes outstanding achievement in promoting the value of CEDS and e-discovery competence to individuals in the e-discovery profession.

4. CEDS Scholarship Award
Given to an individual who is entering into the e-discovery profession and wishes to take the CEDS Certification in order to advance their career. Monies will be paid directly to ACEDS in the name of the winner.
  1. The scholarship is to be used solely and exclusively for the purpose of taking CEDS and to purchase study materials in connection with the preparation to take CEDS. Upon successful completion and passing of the exam, the individual will receive membership in the organization.
  2. Candidates do not have to be ACEDS members and recipients do not have to attend the Conference.
5. Outstanding Local Leader/Rising Star Award
This award recognizes an individual ACEDS member for outstanding leadership in his or her local chapter. Only ACEDS chapter members can nominate candidates for this award.Recipient must have taken CEDS Exam within one year of receiving the award (September 30)

6. Chapter of the Year
This award recognizes an ACEDS Member Chapter for outstanding achievements, successful events, membership growth and excellence in consistently delivering value to the e-discovery professionals in its geographical region.

7. Executive Director's Award  (No Nominations Solicited for this Award)
This award recognizes five (5) ACEDS members who are chosen by the Executive Director and ACEDS management as having been outstanding evangelists for ACEDS in promoting and supporting its mission and purpose.
*Employees of Barbri and/or its affiliates are not eligible to be nominated or receive these awards.
*The nominees will be reviewed and selected by an independent panel of judges appointed by ACEDS management.

IPRO Tech Builds Up eDiscovery Case Management and Data Sharing

This event was held at Winston and Strawn Office, 200 Park Avenue New York, NY on April 7th, 2015.

The title of the event was:   Cybersecurity:  Can a law firm and/or an e-discovery service provider protect a corporate client’s sensitive data during litigation?

Issues that were discussed included: protecting a corporate client’s sensitive data when it is the control of a law firm or e-discovery service provider; tips on preventing a cyberattack; required responses when there has been a data breach; data privacy rights when there has been a hacking incident; best practices for ensuring that a data chain of custody is secure and complete; preparing for an increase in demands from corporate clients for improved security protocols by outside counsel firms and litigation support service providers.
